it's not really an undue burden. But this isn't about that. This is
about checking someone's immigration status when they aren't under
arrest. This isn't about probable cause, which allows you to arrest.
It's about reasonable suspicion, which allows you to conduct a brief
investigation. Checking someone's immigration status can take far
longer than what is allowed under a Terry Stop. What if INS is
swamped with requests and it takes four days to resolve the issue,
despite the best efforts of all involved? And if the cop decides he
has other things to attend to, a legal citizen could be detained
indefinitely until the immigration matter is resolved. That is
unacceptable and unconstitutional.
